1. Scope of application
The following General Terms and Conditions ("GTC") govern the conditions under which the services offered by Molindo GmbH at www.Lyrics.me ("Lyrics.me") can be utilized by users.
Lyrics.me is entitled to amend or supplement these terms of use with a reasonable period of notice. The changes will be announced to users by email. Furthermore, the changes will be announced by publication on the Lyrics.me website. The changes are deemed to have been accepted if the user does not object to the new conditions within 4 weeks of receipt of the notification of change.
2. Service description
Lyrics.me is a community with a focus on music. It allows users to search for song lyrics and information on artists. In addition, members can create their own user profiles, comment on lyrics and artists, create groups, invite other users and make new friends. Lyrics.me reserves the right to offer new functionalities and services on www.Lyrics.me or to remove existing functionalities and services at any time. In addition, existing or new services may be offered for a fee with 4 weeks advance notice.
Lyrics.me offers its services exclusively for private, non-commercial purposes. By registering, each user agrees to use the services for private purposes only.
3. Registration, use
By registering as a member, the user expressly recognizes these terms and conditions as binding for the regulation of the user relationship between the member and Lyrics.me. Conflicting terms and conditions are not recognized.
If offers and services are provided by cooperation partners, their terms of use or general terms and conditions shall apply. The user undertakes to keep passwords received from Lyrics.me for the purpose of accessing their services secret and to inform Lyrics.me immediately as soon as they become aware that the password is known to unauthorized third parties.
If, through the fault of the user, third parties use the services of Lyrics.me through the use of passwords, the user is liable for any damages incurred by Lyrics.me.
4. Contents
Lyrics.me stores images and information for the user or merely provides access. The user is solely responsible for the content posted on Lyrics.me. The user therefore guarantees that this content does not violate legal prohibitions, common decency or the rights of third parties (name, personality, copyright, data protection rights, etc.). In particular, the user undertakes not to present any pornographic content, content that glorifies violence or incites hatred, not to incite criminal acts or to present instructions for such acts and not to offer or have offered any services that involve pornographic content. The same applies to the sending of e-mails.
The posting of content relating to political activities, such as party rallies, demonstrations, leaflet or signature campaigns and the depiction of political symbols is also not permitted. Furthermore, no content may be posted that insults, defames, harasses or harms other members and users in any other way. The user may not send or store any data on a Lyrics.me data carrier which, due to its type or nature (e.g. viruses), size or duplication (e.g. spamming), is likely to jeopardize the existence or operation of Lyrics.me's services and data network.
Lyrics.me is entitled to demand a contractual penalty from the user in the event that the user sends such data to the data carrier. Lyrics.me is entitled to refuse the inclusion of content, to delete content, to immediately delete the pages and links to them, and/or to terminate the contract without notice if the user violates the aforementioned prohibitions, subject to any claims for damages by the user. Lyrics.me assumes no duty of examination. If the user violates the aforementioned prohibitions, the user is liable to Lyrics.me for compensation for all direct and indirect damages arising from this. The user indemnifies Lyrics.me internally from all third party claims resulting from violations.
5. Rights of use
Lyrics.me grants the user a simple, non-transferable right to use the offers and services of Lyrics.me. Upon termination of the contract, the right to use the services expires. By uploading content, the user transfers to Lyrics.me the rights of use to the content uploaded to the platform by the user. The right of use includes the revocable right to worldwide reproduction, distribution, transmission, public reproduction, publication or other comparable use of the transferred content, exclusively within the scope of the offer of Lyrics.me, without any claim to remuneration by the user or third parties. The right of revocation can be exercised at any time by deleting the content.
6. Termination of membership
Any user can delete their membership account at any time for any reason whatsoever. Songetxte.com will then delete the stored data. Lyrics.me may also, at its own discretion and for whatever reason, delete, block or terminate the password, the member account (or parts or specific user content) and also delete any other user content.
This applies in particular if the user has not used Lyrics.me for a longer period of time or if these terms of use have been violated. Any interruption of access to Lyrics.me in accordance with the provisions of this agreement may be carried out without prior notice.
7. Prices and payment for paid services
Lyrics.me offers its services free of charge. Lyrics.me is entitled to offer special services for a fee in the future. Prices and conditions will be displayed to the user in good time before use. Lyrics.me is entitled to charge fees for paid services up to 12 months in advance.
The user agrees to receive invoices electronically if necessary. Lyrics.me is entitled to increase the prices at any time after written notice with a period of 6 weeks. The changed price applies if the user does not object to the changed price within six weeks. The contractual relationship shall then be continued at the changed conditions/prices. If the user objects in good time, both parties have the right to terminate the contract with one month's notice to the end of the month.
Unless expressly agreed otherwise, the prices are fixed prices. If the user is in default of payment, Lyrics.me is entitled to discontinue the services and/or to immediately block the user's membership account or parts of the offer for the user; the user remains obliged to pay the agreed fee for the duration of the blocking.
8. Warranty
Lyrics.me offers its services in the form deemed appropriate by Lyrics.me and subject to the right to interrupt or discontinue them at any time. The user uses Lyrics.me at his own risk. This applies in particular to the downloading or other use of content, especially content from other users.
The user is solely responsible for any damage to his computer system or other technical devices used for use, for the loss of data or for other damage and also for damage to third parties caused by the user in this context. Lyrics.me does not guarantee that the offer will meet the user's requirements and will be available at all times without interruption, in a timely, secure and error-free manner.
Lyrics.me makes no warranty as to the results that may be obtained from the use of the service or as to the accuracy and reliability of the information available through the service. Lyrics.me also does not warrant that the hardware and software used for the Lyrics.me offer will operate error-free at all times or that any errors in the hardware or software will be corrected and assumes no liability for damages resulting from the use or inability to use Lyrics.me, including data loss or data corruption. In particular, Lyrics.me is not liable for costs of replacement or for costs incurred in connection with any goods or services purchased, messages received or other transactions or any alteration of user input or data or in any other way in connection with Lyrics.me.
Lyrics.me also assumes no liability for the behavior of users or other third parties or for content or statements that are passed on by users or other third parties in the context of the offer.
9. Third party rights
Lyrics.me assumes no liability for images posted by users, texts published on the platform or other content. The user indemnifies Lyrics.me from all claims of third parties, which they assert against Lyrics.me due to the violation of their rights, in particular copyrights, licenses, competition or other property rights due to the content transmitted by the user.
The user shall reimburse Lyrics.me for all costs incurred due to legal prosecution and infringing content. For the purpose of legal defense, the user shall provide Lyrics.me with all necessary documents and records. Lyrics.me will indemnify the user from all justified claims of third parties, which are based on a possible infringement of an industrial property right or copyright by Lyrics.me, if the user has informed Lyrics.me of such claims immediately in writing and Lyrics.me reserves the right to all technical and legal defense measures and settlement negotiations.
The aforementioned obligations of Lyrics.me do not apply if third party claims are based on the fact that the infringement is due to an action of the user, in particular the posting of content on Lyrics.me by the user.
10. Liability
Lyrics.me is only liable for damages caused by intentional or grossly negligent breaches of contract. This applies accordingly in the event of a breach of pre-contractual or ancillary contractual obligations as well as in the event of consequential damages. Lyrics.me is only liable for slight negligence in the event of a breach of essential contractual obligations, so-called cardinal obligations, insofar as these damages were foreseeable.
Furthermore, Lyrics.me is liable for damages according to the Product Liability Act as well as for damages due to injury to life, body or health. The defense of contributory negligence on the part of the user remains unaffected by Lyrics.me. The above limitations of liability also apply to breaches of duty by legal representatives or vicarious agents of Lyrics.me. Lyrics.me expressly distances itself from the content of all pages to which direct or indirect references (so-called "links") exist from the Lyrics.me website. Lyrics.me assumes no liability for these contents and pages. The providers of the respective pages are responsible for the content of these pages.
11. Notices of infringement
Lyrics.me respects the intellectual property of others and asks its users to do the same. If anyone believes that their copyrights have been infringed by content on www.Lyrics.me, they are requested to contact us using the following information:
- a description of the copyrighted work that is allegedly infringed
- a description of where the material that is claimed to be infringing is located
- an electronic or physical signature of the person authorized to act on behalf of the copyright owner
- the address, telephone number and e-mail address of the copyright owner
- a statement that, to the best of your knowledge, the disputed use is not authorized by the copyright owner, its agent, or the law a statement under penalty of perjury that the above information is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
12. Data protection
Personal data of the user will be treated confidentially by Lyrics.me in accordance with the legal regulations and will only be collected, processed and used during the contractual relationship without further express consent for the purposes of contract processing, including billing. Data is collected, used and processed electronically. Further information can be found in the data protection provisions.
Lyrics.me uses plugins from the YouTube platform operated by Google, Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. YouTube videos are embedded on Lyrics.me, whereby a direct connection to the YouTube servers is established and YouTube is informed which pages the user has visited on Lyrics.me. If a user has a YouTube account and is logged in, this data is assigned to the personal account and the data stored in it. The integration of YouTube is implemented as a YouTube Data API client application. The use of the API client is subject to the YouTube Terms of Service (ToS) and the Google Privacy Policy.
13. Preservation clause (severability clause)
Should individual provisions of these Terms of Use be or become invalid and/or contradict the statutory provisions, this shall not affect the validity of the remaining Terms of Use.
14. Final provisions
Lyrics.me is entitled to transfer all contracts with the user that fall within the scope of these GTC in whole or in part to a third party with discharging effect. The user hereby agrees to such a transfer of contract. In the event that Lyrics.me makes use of this transfer option, the user has the right to terminate the contract without notice.
For all legal relationships between Lyrics.me and the user, the law of the Federal Republic of Germany applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods. If the user does not have a general place of jurisdiction in Germany or in another EU member state, is a merchant or moves his permanent residence abroad after these General Terms and Conditions come into effect, or if his place of residence or habitual abode is unknown at the time the action is filed, Munich shall be the exclusive place of jurisdiction. Registration for Lyrics.me can only be made via this website in German.
